1. Application and approval terms

1.1 The order and sale of products via www.Mosaicshop.be is offered to you by Mrs Shirley Arisiaman, a self-employed trader trading under the name Mosaicshop, with company number 0839.186.095 and registered office at 3560 Lummen Linkhoutstraat 212 (hereinafter the Seller); these general terms and conditions of sale are those of the Seller.

1.2 "Buyer" means any natural or legal person who purchases one or more products via the webshop as well as any visitor to the webshop.

1.3 These terms and conditions of sale apply to all sales offered on and realised via the webshop www.mosaicshop.be or other agreements concluded via the webshop.

1.4 These terms and conditions apply to the exclusion of all other terms and conditions, in particular those applying to sales or rentals in the seller's shop.

1.5 The seller operates exclusively in Europe. Consequently, the seller can only accept your order if the delivery address is located in Europe and is not a PO Box address.

1.6 By placing an order via the webshop, the buyer declares to have read the terms and conditions of sale and accepts them. 

1.7 If one or more articles of these terms and conditions are declared invalid by a court decision, the remaining provisions of these terms and conditions of sale will remain in full force.

2. Realisation of the agreement

2.1 A sales agreement between the seller and the buyer will only be concluded after the order of the (potential) buyer has been explicitly accepted by the seller, who will inform the buyer of this in a letter of confirmation. 

2.2 The moment the buyer receives the letter of confirmation constitutes the conclusion of the agreement.

2.3 The seller reserves the right not to accept the order or, as the case may be, to terminate the agreement without being liable to pay any compensation to the buyer but only on condition that any amounts paid are refunded. 

In particular, if problems have arisen in the past with the person placing the order or his family members in the case of natural persons, as well as if problems have arisen in the past with the delivery address provided or in the case of outstanding invoices.

3. Prices

3.1 The prices of the products are indicated in euros with all taxes included, except for the participation in the shipping costs.

3.2 The seller reserves the right to change its prices at any time, nevertheless, the products will be invoiced on the basis of the rates in force at the time the order is accepted.

3.3 The seller cannot be held liable for (typing) errors that appear in its offers and that the buyer should reasonably assume are (typing) errors.

3.4 The price payable shall be that specified in the confirmation letter.

3.5 The seller reserves the right to change the price payable after the conclusion of the agreement, for example on the basis of price changes affecting shipping costs, new taxes or (typing) errors. 

3.6 If the price is increased, the buyer will be entitled to dissolve the agreement without any costs being incurred by him or any obligation on the part of the seller to pay any compensation.

3.7 The products remain the property of the seller until full and final payment of the price has been received.

4. Payment

4.1 The following payment options are available for ordering products via the webshop:

When using the above-mentioned payment systems, the buyer must of course also respect any conditions of the operators concerned; the vendor is also not a party in the relationship between the buyer and the operator of the payment system.

4.2 The seller undertakes to do its best to guarantee the safety of the user of the webshop, but can under no circumstances be held liable for any damage caused by the unsafe, incorrect or negligent use of the webshop by the buyer himself, nor for any damage caused by third parties who misuse the website or payment system, except in the event of gross negligence or intent on the part of the seller, his employees or agents. 

4.3 The seller complies with the rules for allowing the refund of sums paid by the consumer in accordance with the Law of 6 April 2010 on Market Practices and Consumer Protection. 

4.4 In the event that a term of payment has been stipulated, and in any event 30 days after delivery, the buyer shall be liable, ipso jure and without prior notice of default, for late payment interest at a rate of 1% per month and damages of 10% with a minimum of €50.00.

5. Delivery

5.1 The products will be sent to the shipping address that is specified in the order (home address or other address).

5.2 Naturally, the seller will make every effort to deliver the products within the shortest possible time, the buyer will make every effort to accept the products during the delivery period. 

5.3 If the ordered goods are not delivered within 30 days, an additional period may be agreed between the buyer and the seller.

In the absence of an additional period, the agreement shall be dissolved by operation of law and the seller shall refund any payment received within 30 days.

6. Right of renunciation

6.1 The renunciation right only applies to purchases via the webshop by natural or legal persons who acquire or use these products exclusively for non-professional purposes.

6.2 The Law of 6 April 2010 on Market Practices and Consumer Protection allows consumers to notify the seller of their wish to cancel the sale within 14 calendar days of receipt of the product, without penalty and without giving a reason.

6.3 The goods must then be returned within the same period at the expense of the buyer in the original, undamaged and original packaging, without any printed tape, nor stickers, nor any writing on the box, together with all accessories, the user manual and (a copy of) the invoice/delivery note to

Original packaging with writing on it or with transport and/or other stickers will not be accepted.

6.4 Incomplete, damaged, used or soiled goods will not be taken back.

6.5 Within 30 days after acceptance of the return, the seller will refund any sums paid, except for the direct costs of returning the goods (cf. articles 5.3 and 6.3).

6.6 In the event that, pursuant to article 6.5, the seller has not effected repayment within 30 days of accepting the return, the seller shall, ipso jure and without prior notice of default, be liable for late payment interest of 1% per month and damages of 10% with a minimum of €50.00.

6.7 Pursuant to Article 47 §4, 2° & 3° of the Law of 6 April 2010 on Market Practices and Consumer Protection, the renunciation right does not apply to :

- the delivery of goods made to the consumer's specifications or which have a clear personal character or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly

7. Privacy

7.1 Your personal data will be stored by the seller and kept in your personal account in order to allow the seller to execute your transaction correctly. Once these data are stored, your subsequent transactions will be faster.

7.2 The vendor complies with the Belgian law of 8 December 1992 on the processing of personal data, amended by the law of 11 December 1998, which takes account of the European Directive of 24 October 1995.

This law stipulates that the person or company collecting data must have the consent of the person whose personal data are concerned, that the data must be relevant, accurate and correct and that they must be collected for specific, clear and legal purposes. The person whose personal data is concerned must have access to it and the right to modify the information concerning him/her. 

7.3 The seller undertakes not to pass on any personal information to other organisations for commercial or non-commercial purposes.

8. Applicable law

8.1 The sale to which the present terms of sale relate is subject to Belgian law. 

8.2 Only the courts of the judicial district of Hasselt have jurisdiction.
